A Virtual Bankruptcy Assistant (aka “VBA”) is someone who works for bankruptcy attorneys as an independent contractor. VBAs own their own business. We bill the attorney for work that we perform and the attorney pays us directly. We are not an employee of the attorney. Instead, the attorney is our customer. Additionally, VBAs are responsible for paying your own income, state and other applicable taxes and keeping good accounting records as any business owner should.
The word: “virtual” simply means that a person works virtually in their own office and communicates with their attorney via the internet.
The words: “bankruptcy assistant” is a term used for people who gathers information from debtors and drafts the bankruptcy petition. The “bankruptcy assistant” submits this information to the attorney (via the internet in PDF format). The attorney reviews the work produced by the VBA, submits revisions and the VBA provides the final completed bankruptcy petition to the attorney, ready for electronic filing.
